Fair housing basics for landlords
The federal Fair Housing Act protects seven characteristics: race, color, religion, sex, national origin, familial status and disability. Many states and cities add more, such as source of income, age, marital status or criminal history. Good practice:
Use the same application, criteria and fee for every applicant, and write your screening criteria down before you advertise.
Ask about occupants for occupancy limits, but not about pregnancy or plans to have children.
Treat assistance animals for people with disabilities as a reasonable accommodation, not as pets.
If you deny an application because of information in a consumer report, the federal Fair Credit Reporting Act requires an adverse action notice naming the screening company.
Keep completed applications secure, since they contain sensitive personal information, and shred them when you no longer need them.
This is general information, not legal advice. Check your state and local landlord-tenant rules, or ask a local attorney, before using the form.
Common screening criteria
Criterion
Typical rule of thumb
Income
Gross monthly income of about 2.5 to 3 times the monthly rent
Rental history
Positive references from recent landlords, rent paid on time
Credit
A minimum score or no recent collections for rent or utilities, as set by the landlord
A standard rental application asks for the applicant's contact details, the property and move-in date, current and previous addresses with landlord contacts, employment and monthly income, other occupants, pets and vehicles, references and an emergency contact, plus a signed authorization that lets the landlord check credit, rental history and income. This generator includes all of these and lets you turn optional parts off.
Is it legal to ask for a Social Security number on a rental application?
In most of the US, landlords may ask for an SSN or ITIN to run a credit and background check, but applicants without one should be offered another way to verify identity and credit, and the information must be stored securely. Some states and cities limit what can be asked. If you do not run credit checks yourself, untick Screening details.
What questions are landlords not allowed to ask?
Under the federal Fair Housing Act you may not discriminate based on race, color, religion, sex (including sexual orientation and gender identity), national origin, familial status or disability, so avoid questions about these, such as nationality, religion, pregnancy, plans to have children or medical conditions. Many states and cities add protections, for example for source of income or criminal records. Ask the same questions of every applicant.
How much can a landlord charge for an application fee?
It depends on the state. Several states cap rental application fees or require them to match the actual cost of screening, and some require a receipt or a refund if no screening is done. Enter your fee in the fee box and check your state and local rules before charging it.
Can applicants fill in and sign the PDF on a computer?
Yes. With Fillable PDF on, each shaded box is a text field and each square is a checkbox, so applicants can type their answers in a free PDF reader or most browsers and save or print the file. The signature line is a text field; for a verified electronic signature, use an e-signature service with the completed PDF.
Should every adult fill out a separate application?
Yes. Landlords usually require a separate application, screening and signature from every adult 18 or older who will live in the home. You can add a co-applicant section for a couple applying together; otherwise the form reminds applicants that each adult applies separately.
Is my information uploaded anywhere?
No. The form is generated entirely in your browser and the PDF is created on your device. Your settings are saved only in this browser so you can change them later.
